Are there any guidelines I need to know if I want to use photos or copies of items made for customers in marketing. I'm working on developing a web page, but I assume the same questions are relevant for store display pieces.

1)Can I use images/copies of anything made for customers?
2)When do I need permission?
3)Should I put a statement on the web site's policy page to cover myself?
4)When do you recommend against using actual customer items?

I'm trying to find out what other people are doing, and if this is really an issue or not.

It is my understanding that any commercial use of a customer's image requires a model release form for safety.

That being said, I have used a few imaged items for display without one. They are something like an imaged dog tag that had a message engraved wrong on the back, darned employees, I never :>P did that myself. The customers are usually tickled by their image on display. If they were to object it is simple to take it down and that would be that.

I would be more cautious on a website. People think you make a fortune there and would want a piece of the imaginary pie. There I use only pictures of my family and those that came in the item like in frames.

Harvey,

You raised a good point, a store vs. Internet being perceived differently. I had not thought of that.

When I used the word "image" I wasn't thinking in terms of a persons photo engraved. I was thinking of using a photo, taken for marketing / web display, of an engraved gift item. The gift item is engraved with a message from my customer to the gift recipient.

I always enjoy reading the different points of view postings generate.

We refer to impact engraving and necklace photo imaging as 'Images' in my store. Therefore you can understand my instant impression of the use of the word. I still have not gotten cured of brain drag from Christmas. Two weeks of 14-16 hour days seven days a week, rushing all of the time takes a toll.

Thank goodness, this year the toll may go to the bank finally.

Harvey, if you are going to insist on sitting under a bridge for 14-16 hours a day and demanding a fee from everyone that......

"Spectrum Graphics reserves the right to to use all products in advertising and promotinal displays unless otherwise specified in writing at time of order"

It doesn't cover everything but have yet to have a client balk. Of course, I don't have Disney as a client, yet, so who knows?

I was thinking of something along those lines. That's probably what I'll be doing.
